Should I hire an lawyer for my car accident case?

I was recently in a rear end car accident where I was not at fault. I was taken via ambulance to the hospital and given x-rays and was diagnosed with having cervical strain and wiplash. I have no medical insurance (i'm only 21) and my neck is still bothering me. I had talked to a lawyer and he said that if I have him represent me then i can go to the chiopracter and they will pay for is until i settle with the other persons insurance company and add those bills in with my emergancy room bills. So if I don't hire that lawyer i can't go the chiopracter but if I do then I can. I know he said he would take 1/3 out of what I get but i've herd that you get more with a lawyer. Please help?

Individuals injured in auto accidents may be eligible for monetary compensation for their injuries, medical bills, lost wages, pain and suffering, and other damages. Each car accident case is unique, and may involve complex issues including liability (i.e., fault), insurance coverage, and causation of damages. Consulting with an experienced attorney can help you gain a clear understanding of your rights.

The Types of Damages In a Car Accident.

There are a number of types of “damages” incurred when someone is hurt in an automobile accident. “General” damages, for example, include those things for which an exact dollar amount cannot be calculated.

Examples of general damages include:

  • pain and suffering,
  • loss of companionship,
  • permanent impairment or disfigurement,
  • loss of enjoyment of life,
  • and compensation for a shortened life expectancy.

“Special” damages, on the other hand, include:

  • medical bills,
  • lost wages,
  • and car repair costs.

Victims of automobile accidents may also recover money for reasonable future medical bills and future lost wages.

Also, merely because an injured party in an automobile accident was already suffering from a previous injury, does not necessarily mean he or she is barred from monetary recovery. If the accident aggravated or worsened the existing injury, such aggravation or worsening may be compensable.

Auto Insurance and the Lack Thereof.

Often times auto accident victims who recover in court or via settlement are paid by the other (i.e., at fault) driver’s insurance company. However, if the other driver is uninsured or under-insured, the accident victim may recover from his or her own insurance company provided such coverage is contained in his or her policy. Other types of insurance coverage may apply depending on the specifics of the particular case.
