Talked to lawyer regarding car accident. Does what he say sound weird?

I talked to a lawyer regarding a car accident my wife was in last week. Basically, a drunk driver rear ended her on the freeway. He does not have insurance. Luckily we have uninsured motorist insurance.

What the lawyer said was that she could go to a “special car accident clinic” to get treatment. There is no cost up front.

The lawyer would then ask our insurance company to pay for medical bills from this clinic (let's say they're $10,000).

After our insurance company agrees to pay us the $10,000, he goes back to the clinic which will then only take, let's say, $4,000 as payment. We would then keep the $6,000 difference minus the lawyer's cut.

Is this commonplace? The lawyer assured us this is “how the system works”.

Also, if the insurance company, for whatever reason, decides to not pay the medical bills, would we be stuck with the bill or would it work like with a lawyer where they only get payed if there is a settlement?

• A great follow up question to the previous one is, how many trials have you personally won? This question will give you more detail in regards to their experience.
• To give you an idea of how an attorney thinks you should ask them, how would you handle my case in regards to my particular situation? This is also a great way to see if they have really looked at your case.
• If you are interviewing a person injury lawyer at a large firm, be sure to ask if they will be the one who will actually handle your case or will one of the associates. You definitely want to interview the person who is going to be working your case.

These four questions will help you be well on your way in finding a great injury attorney. Of course, there will be more questions that will come up, but make sure they stay focused on your specific case and about the tort law in general. You will definitely come away with a better understanding of the law.
