If someone is in an car accident, and they survive, people say thank God, but was it Gods fault?

Gods, fault that the person was in a car accident in the first place.


Car accident questions?

I got into a car accident last night in Brooklyn on the East bound Belt Parkway. Two cars (a gold Chevy Trailblazer and a black 5series BMW) were trying to merge onto the highway that me and a White Nissan Murano were already on. I am behind the Nissan Murano on the highway and the BMW is behind the Trailblazer waiting to get on to the highway. The BMW decides that he doesn't want to give the right of way to us (the people already on the highway), and cuts everyone off (the trailblazer, the Murano, and my 2001 Nissan Sentra). The Murano stops short and I slam into the back of him. My airbags deployed and my car is totaled. The Murano bumper has a crack in it (nothing major- probably because he had the bumper guard) and he might have some damage underneath his car (nothing visible but you never know). The BMW fled the scene and no one got a license plate number. The trailblazer did not hit anyone but has slight damage caused by the BMW that fled the scene. Yes I tried braking but it didn't slow down enough in time. Everything happened within 10 seconds. I have several questions:

1. Is there any way that I will not be found at fault? Like if an investigation is done and they find out that I had bad brakes?

2. If they launch an investigation and find that my brakes were faulty would that change anything?

3. Does anyone pay for the damage to my car? I only have liability coverage but maybe his insurance? Can I pay for full coverage now so that they will pay for my car?

4. $3500 is what I paid for the car. The car will cost at least $3000 to fix. What should I do with the car if insurance doesn't want to reimburse? I called a couple of junkyards and they told me around $150. I think that is too low-what about you? I also called a charity to see about donating it and they said that I could get a $300-500 tax credit when I file taxes for 2009. I heard bad things about that but only from 2 people so I really don't know. Anyone know anything about that?

5. How much do you think, in percentage, will my insurance go up?

6. If I took the car and tried to do a trade-in, will they give me much for thfor it?

7. Finally, I am in pain. My entire right side of my body hurts, from my neck to my ankle, including my lower back. Can I get a personal injury settlement? The towing people that came to the scene said that I can. I don't know.

Final tidbits of information, I live and the accident took place in Brooklyn, NY. I am a 21 year old female. Car is registered and owned by me, all in my name. I had my license for 23 months, will be 2 years in June. I bought the car from some people that took me to an auction. Car was sold as is from the auction to the dealer that bought the car for me. But I am not sure if it is as is from the dealer to me?? I went to a dealer's auction so I had to have a dealer buy and then buy from that dealer (for people that don't know).
